Tesla CEO Elon Musk is escalating his fight with California county, restarting a Tesla factory in Fremont despite a stay-at-home order. CNBC’s “Squawk on the Street” team discuss.
CNBC’s Jim Cramer said Tuesday that he sides with Elon Musk in the Tesla CEO’s fight with local officials over reopening the company’s auto manufacturing plant in Alameda County, California, south of San Francisco.
“I think he’s dead right,” Cramer said, in reaction to Musk saying that Tesla restarted production at its Fremont factory on Monday, in violation of a county coronavirus mitigation order against reopening nonessential businesses.
Cramer admitted Musk is a “zealot,” referencing rants about state stay-at-home orders since the company’s first-quarter earnings were released late last month. Musk has described the restrictions aimed at slowing the spread of Covid-19 as fascist, and he urged governments to ease restrictions.
However, the “Mad Money” host, who has erred on the side of caution in commenting on the need to get Americans back to work and prevent further loss of life, said it’s time to open Tesla’s Fremont factory.
Shortly after Cramer’s comments on “Squawk on the Street,” President Donald Trump tweeted that “California should let Tesla & @elonmusk open the plant, NOW. It can be done Fast & Safely!”
On Monday, Treasury Secretary Steven Mnuchin backed Musk in a CNBC interview. “He’s one of the biggest employers and manufacturers in California, and California should prioritize doing whatever they need to do to solve those health issues so that he can open quickly and safely,” Mnuchin said.
For Alameda’s part, County Supervisor Scott Haggerty said: “I wish Elon would have waited one more week. So we could have just done this in a methodical fashion that really put people back to work safely.”
Musk, in a tweet confirming the resumption of production, practically dared authorities to arrest him.
Tesla’s Fremont plant had been closed since March 23.
Monday’s restart came days after Tesla sued the Alameda County Health Department seeking to overturn its order and after Musk threatened to move Tesla’s manufacturing operations and headquarters out of California.

All he had to do was wait a couple more days for the county to work out the health risk. He’s smart so this was probably a calculated move or a temper tantrum. Either way the guys in this video should not be who we listen to when it comes to a health crisis.
Irresponsible leadership,. Moving the factory is irresponsible to workers, community, and stockholders. Breaking the law during a pandemic is just bad business.

Not really against opening up but this is an example of if you're rich enough laws don't really apply to you.
The lawlessness in this entire situation just astounds me. Keeping the factory closed until it has appropriate health and safety measures for a deadly pandemic isn't "nice" or "a burden." It is mandatory, because it is the law.
If Musk or his associates don't like the local health and safety laws, they can campaign with their own candidates in the next election and if they win, revoke them. What they cannot do is simply unilaterally open.
When this backfires, it will do far more damage than a week of downtime to make the factory safe. California is Tesla's primary market and insulting it is a bad idea as Ford and GM get EVs into market; further, Musk would be nothing without "overbearing liberal California." Then there is the issue of illegal operations putting insurance and other things in jeopardy — there isn't an insurance company out there who would cover any worker injuries resulting from illegally operating, as the factory is right now.
There is a reason that big success stories like PayPal and Tesla, which both made Musk very wealthy, happen in California and not MAGA country. While I'm not surprised to see the MAGA contingent demand that worker safety laws be revoked, I suspect the average employee won't be too pleased if/when the factory becomes a COVID hotspot and the inevitable massive lawsuits kick in.
I dunno, USA has almost 40,000 traffic deaths per year. Why not ban driving a car?

Even pre covid, the factory has been slapped with so many work related violations. Accidents going in there that seems to get swept under the rug. We all know he's doing all this to get his $700+ mil bonus.
