THE BOOMER COALITION CONCERT SWEEPSTAKES OFFICIAL RULES

  • OPEN TO LEGAL U.S. RESIDENTS (EXCLUDING RESIDENTS OF FLORIDA AND PUERTO RICO),
  • 18 YEARS OF AGE OR OLDER AT TIME OF ENTRY.
  • VOID IN FL, PR AND WHERE PROHIBITED.
  • NO PURCHASE NECESSARY TO ENTER OR WIN.
  • A PURCHASE OR TRANSACTION WILL NOT INCREASE YOUR CHANCES OF WINNING.
  1. HOW TO ENTER:

The Boomer Coalition Concert Sweepstakes (the “Sweepstakes”) begins 12:01 AM Eastern Time (“ET”) on 6/1/04 and ends 11:59 PM ET on 9/15/04 (“Entry Period.”) There is one method of entry into this Sweepstakes. No other method of entry will be accepted. During the Entry Period, go to www.boomercoalition.org and submit your vote on the musical artists that would make up your dream concert. After voting, complete and submit the entry form to receive an entry into the Sweepstakes. Online entry must be received by 11:59 PM ET on 9/15/04 in order to be eligible for the prize drawing. Your vote will not affect your entry in any way. Boomer Coalition (the “Sponsor”) will not acknowledge receipt of entry. All entries become the property of Sponsor and will not be returned.

  1. TELL-A-FRIEND:

You are eligible to earn additional Sweepstakes entries via the Tell-A-Friend method. When submitting your entry online, fill in the names and valid email addresses of up to five (5) friends. You will earn one additional entry for each valid and unique email address you refer who registers with the Sweepstakes. Limit five (5) additional Tell-A-Friend entries during the Entry Period.

  1. SELECTION OF WINNERS:

A random drawing will be conducted on or about 9/16/04 from among all eligible entries received by Seismicom, Inc., (the “Administrator”), an independent judging organization, whose decisions are final and binding on all matters relating to this Sweepstakes. Odds of winning depend on the number of eligible entries received. Potential winners will be notified by mail, email and/or telephone. If notification is via email, potential winner will have 48 hours to respond to Administrator with a valid mailing address or prize will be forfeited and awarded to an alternate winner. Potential winners may be required to sign an Affidavit of Eligibility/Liability Release and where legal, Publicity Release within seven (7) days of issuance of notification. Failure to return these documents in the time noted, return of prize or prize notification as undeliverable, or noncompliance with these Official Rules, will result in disqualification of the entry and an alternate winner will be selected.

  1. ENTRY LIMIT:

Limit one (1) entry and five (5) Tell-A-Friend entries per person and/or email address during the Entry Period. Additional entries attempted by a single entrant are void. An email address may only be used once, and not for multiple entrants. Any entries submitted beyond the limits specified herein, by a single entrant, whether via online or Tell-A-Friend method, are void. Subsequent attempts made by the same individual to enter by using multiple email addresses or otherwise will be disqualified. Entries generated by script, macro or other automated means are void. Online entrants must submit a vote and complete the information requested on the entry form. Incomplete online entries are void. By entering, entrants acknowledge compliance with these Official Rules and the decisions of the Sponsor and judges, which are final and binding on all matters relating to this Sweepstakes. Released Parties (as defined below) are not responsible for incomplete, misdirected, late, undelivered or garbled entries, or for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any web site or internet service, or any other error or malfunction.

  1. PRIZE:

One (1) Grand Prize: a 3-day/2-night trip for two (2) to New York City. Trip consists of roundtrip coach air transportation for two from major US gateway airport nearest winner’s residence, two (2) nights standard double occupancy hotel accommodations (room and room taxes only – extra incidentals are the responsibility of winner), and two (2) tickets and backstage passes to the Boomer Coalition Concert in New York City scheduled to be held on 10/13/04. Approximate retail value (“ARV”) is $5,000. Ten (10) First Prizes: an MP3 Player, T-shirt and CD (artist to be determined by Sponsor). ARV $250 each. Fifty (50) Second Prizes: a T-shirt and CD (artist to be determined by Sponsor). ARV $50 each. Total ARV of all prizes: $10,000. Actual value of Grand Prize may vary based on travel dates and point of departure. Travel dates and times, airline, hotel and exact location of seats at Concert are at the discretion of Sponsor. Concert tickets are subject to certain terms and conditions. Released Parties are not liable for any expenses incurred as a consequence of a flight cancellation or flight delay. Prizes are non-transferable and no cash redemption or substitution is permitted, except by Sponsor who reserves the right to substitute a prize of comparable or greater value if advertised prize is not available. If winner cannot accept the prize, then the prize will be forfeited and awarded to an alternate winner. All prizes being offered are being provided “as is” with no warranty or guarantee either expressed or implied by Sponsor. All details of all prizes shall be at Sponsor’s sole discretion, including, without limitation, all travel arrangements in connection with the Grand Prize, which must be made through Sponsor’s agent and on a carrier of Sponsor’s choice. Winner assumes sole responsibility for any costs associated with the prizes not explicitly outlined above, including but not limited to any and all taxes, fees, surcharges on a prize, and, for the Grand Prize winner, any additional meals, tips, gratuities, sightseeing, souvenirs and incidentals. Grand Prize winner must travel on dates specified by Sponsor or prize may be forfeited and awarded to an alternate winner. Guest of Grand Prize winner must be 18 years of age or older, unless the Grand Prize winner is the guest’s parent or legal guardian, and will be required to execute and return a travel/liability, and (where legal) publicity release prior to issuance of travel documents. If guest is an eligible minor, such document must be executed and returned by the parent or legal guardian. Grand Prize winner and guest must travel together on the same itinerary. Travel is subject to availability and confirmation of reservations. Travel restrictions/blackout dates may apply. If the Concert is cancelled, Sponsor will have no further obligation to such Grand Prize winner other than to award the trip plus a prize element of Sponsor’s choosing, of comparable or greater value to the ARV of the applicable prize activity. Limit one prize per person and/or email address. All federal, state and local taxes (if any) are the sole responsibility of the winner.

  1. ELIGIBILITY:

Sweepstakes is open to legal U.S. residents (excluding residents of Florida and Puerto Rico), 18 years of age or older at time of entry. Void in FL, PR and where prohibited. Not eligible to enter are employees (and the immediate families and household members of such employees) of Sponsor, StrawberryFrog, Seismicom, Inc., and their respective parents, affiliates, subsidiaries, advertising and promotion agencies, and suppliers. Sweepstakes is subject to all federal, state, and local laws.

  1. GENERAL CONDITIONS:

Participants agree to release and hold harmless the Sponsor, StrawberryFrog, Seismicom, Inc., and their respective parents, affiliates, subsidiaries, advertising and promotion agencies, and suppliers, and each of their respective officers, directors, shareholders, employees and agents (collectively, the “Released Parties”) for injury, loss, damage, claims or actions of any kind resulting from participating in this promotion or from the acceptance or use of a prize that may be won (including any travel or activity related thereto). By entering Sweepstakes, the winner consents to the use by Sponsor and its designees of his/her name, city and state of residence and/or photograph for advertising, promotional and other purposes online and off-line without additional compensation, unless prohibited by law. Sponsor reserves right to verify eligibility qualifications of winner. Online entry will be declared made by the authorized account holder of the email address submitted at time of entry. “Authorized account holder” is defined as the person assigned to the email address by an internet access provider, on-line service provider or other organization responsible for assigning email addresses. If the Sponsor determines, in its sole discretion, that there is any suspected or actual electronic tampering with the Sweepstakes, or if technical difficulties compromise the integrity of the Sweepstakes, the Sponsor reserves the right to void the entries at issue and/or suspend, modify, and/or terminate the Sweepstakes and conduct a random drawing to award the prizes using all eligible, non-suspect entries received as of the event requiring such termination. If the Sweepstakes is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted at www.boomercoalition.org. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor or its agents.

  1. WHO WON?:

The names of the winners will be available on or after 10/29/04 and can be obtained by mailing a self-addressed stamped envelope, for receipt by 10/29/04 to: The Boomer Coalition Concert Sweepstakes Winners, PO Box 9269, Medford, NY 11763-9269.
